LP Propane Equipment Lease Agreement

1. DESCRIPTION OF EQUIPMENT: LP Propane hereby agrees to lease to Lessee, and Lessee hereby agrees to lease from LP Propane the following:

2. TANK LEASE PAYMENTS: Lease begins on (Agreed Upon Date). Lease amount of (Agreed Upon Amount) per tank per year. This agreement will automatically renew for an additional term of one year immediately upon expiration of the term currently in effect, unless a written notice of termination shall have been sent by either party. Lease may be renegotiated annually, with customers approval.

3. OWNERSHIP OF LEASE PROPERTY: Lessee agrees that equipment listed above is, and shall remain the sole property of LP Propane. At no time shall Lessee have ownership rights to the leased equipment or should said property be considered a fixture to real estate to which it may be attached. Lessee specifically acknowledges that LP Propane has the sole right to fill the leased property with propane gas.

4. ENTRY TO PREMISES: Lessee hereby grants safe access to enter onto premises at any time as reasonably required by LP Propane personnel and equipment to 1) install, maintain, and service the leased equipment; 2) fill leased equipment with propane gas; 3) inspect leased equipment and the manner of use; 4) repossess the leased equipment upon termination of this agreement. (Includes buildings, fences, trees, shrubs and lawn to be maintained in a manner to such access.)

5. INSTALLATION, MAINTENANCE, and SERVICE: LP Propane agrees that it shall install the leased equipment on the premises in a manner consistent with recognized safety standards existing at the time of installation. Lessee agrees not to alter or in any way tamper with the mechanical operation of the equipment and system. Lessee agrees to notify LP Propane of any damage to or destruction of the leased equipment as soon as Lessee becomes aware of such damage or destruction. In the event of any damage or destruction LP Propane will service, repair or replace the equipment as LP Propane believes necessary, and Lessee agrees to reimburse LP Propane for all materials and labor if damage or destruction of equipment is caused by, or arises from Lessee's intentional and/or negligent acts, and/or failures to act.

6. INDEMNIFICATION: LP Customer agrees to indemnify and hold LP Propane, its agents and employees, harmless from all claims and liability for damages of any kind to persons or property occasioned or contributed to or by the use of the equipment/system furnished to Lessee.

7. DEFAULT: Default shall be defined as Lessee's failure to: 1) Pay lease when due: 2) Comply with the Agreement provisions; 3) Pay for gas supplied by LP Propane when payment is due. Should the Lessee default and correct the default payment within 10 days LP Propane may do any of the following: A) Terminate this agreement; B) Enter the premises to remove the equipment; C) Retain any advance lease paid; D) Charge lessee a pickup fee and/or retain any propane gas contained in the removed tank necessary to pay any sums due LP Propane.

8. OUT OF GAS PROCEDURE: Lessee agrees to be an auto fill customer or in the event the lessee chooses to personally manage the propane supply to the tank the leese agrees to notify LP propane before the tank runs empty and or will require a delivery before the regularly scheduled route day to that area. In the event your tank is empty, upon our delivery we will "by law" need to access your home to do a pressure test and put your appliances back into service. An off-route fee (no less than $150) will be assessed to the lessee if delivery is needed and made before a regularly scheduled route day, plus a pressure check fee of $50 will be accessed on all out of gas calls requiring a pressure test and relite.

9. NON-ASSIGNMENT of AGREEMENT: This contract is non-transferable and any fees paid are non-refundable.
